What is the Purpose of Probate?

It is often necessary to engage the probate court when handling a person's estate once they have passed away. If a person dies without a will in place, probate is used to decide who will receive what. When a will is in place, probate determines if the will is valid. The probate court also grants the necessary authority for the executor or administrator to conduct business on behalf of the estate. That authority is regularly required by banks, mortgage companies, creditors, and other such entities, for the purpose of settling estate matters.
